These terms apply when you use Bushround. Bushround is provided by Mark Stevens Limited, trading as Bushround ("we", "us"). By signing in, you agree to them. If you're accepting them for a group or club, you confirm you can do that on its behalf.
1. The service
Bushround helps groups record conservation and beekeeping work: traps, bait stations, weeds, hives, monitoring, wasp nests, hazards and photos. It's currently offered free, including to pilot groups. We're constantly improving it, and features may change.
2. Accounts and groups
- You sign in with your own email address. Keep access to that email secure, and don't share your sign-in.
- Each group decides who joins it and what role they have. Coordinators can add and remove people.
- You must be 16 or older to have your own account. Younger people take part through a teacher, leader or parent.
3. Your group's information
- Your group owns its records. You give us permission to store, process and display them only so we can provide Bushround to your group.
- Groups can export their information at any time, and we delete it on request when a group leaves.
- Only add information you're allowed to share, and respect landowners' and other people's privacy. Our privacy statement explains how we handle personal information.
4. Using Bushround responsibly
Please don't:
- use Bushround for anything unlawful, harmful or misleading;
- try to access another group's information, or get around sign-in or permissions;
- upload malware, or overload or disrupt the service;
- record sensitive locations, such as wāhi tapu or nesting sites of taonga species, against the wishes of mana whenua or landowners.
5. Safety and your legal obligations
- Beekeepers remain responsible for registering apiaries, the Annual Disease Return, Certificates of Inspection, and reporting AFB to the AFB Management Agency.
- Suspected yellow-legged hornets and other exotic pests must be reported to Biosecurity NZ (0800 80 99 66).
- Work on private land, reserves or public conservation land needs the right permissions. Use of traps, toxins and herbicides must follow the law and the product label.
6. Availability
We work to keep Bushround running and your information safe, with regular backups. But it's provided "as is", and we can't promise it will always be available or error-free. Keep your own copy of anything you're legally required to keep. The app's export tools make that easy.
7. Plans and payments
Bushround is free at the moment. If we introduce paid plans, we'll tell groups at least 30 days before anything changes, and prices will include GST. If a paid plan lapses, a group becomes read-only. We never delete a group's information for non-payment without notice.
8. Liability
To the extent the law allows, we're not liable for any indirect or consequential loss, or for loss caused by information users enter. Our total liability is limited to the amount the group paid us in the 12 months before the claim (which may be nothing).
Nothing in these terms limits any rights you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 that can't be excluded. If your group uses Bushround for the purposes of a business, you agree the Consumer Guarantees Act doesn't apply.
9. Ending your use
You can stop using Bushround at any time, and a group can ask us to close its space and delete its information. We may suspend access that breaks these terms, or that puts others' information or the service at risk. We'll tell you why, unless the law or safety stops us.
10. Changes to these terms
We may update these terms. We'll post the new version here, and tell groups about significant changes before they take effect.
11. New Zealand law
These terms are governed by New Zealand law, and New Zealand courts have jurisdiction.
